Public Holiday Provisions In India

The Ministry of Home Affairs letter No. 14046/27/83-GP-I, dated 15 February 1984, is the basis on which the administrations of the union territories choose the list of holidays. Under this letter, they are required to observe a total of 16 holidays, including the three national holidays of Republic Day, Independence Day, and Mahatma Gandhi's birthday.

The Negotiable Instruments Act of 1981 governs the declaration of the holidays. They mainly apply to government agencies, and banks in particular. Factories and other enterprises in the commercial and public sectors do not typically adopt them. According to the Industrial Employment (Standing Orders) Act of 1946, provisions relating to workdays are included in the Standing Orders of enterprises. Wherein provisions relating to employees working on different days as required by the organization are stated and details are provided regarding their off days for working.

The laws governing factories in our nation do not either allow for the granting of festival holidays to industrial personnel. However, despite this, there are still a number of paid holidays and festivals observed at factories and other industrial establishments. The number of these vacations is typically set by factory owners in their standing orders or service regulations. States also declare paid holidays with a lot of generosity.
